CONLEY III, son of EDMOND CONLEY JR. and JANE PELPHREY, was born January 10, 1823 in Morgan County, Kentucky, died April 10, 1902 in Litterals Fork, Magoffin County, Kentucky, and is buried in the Blanton/Conley Cemetery in Litterals Fork, Magoffin County, Kentucky. He married (1) ELIZABETH MCCARTY, daughter of THOMAS MCCARTY and MARGARET SALYER, December 14, 1846 in Johnson County, Kentucky. She was born about 1828 in Virginia, died June 7, 1880, and is buried in the Blanton/Conley Cemetery in Litterals Fork, Magoffin County, Kentucky. He married (2) ELIZABETH JANE DEROSSETT, May 10, 1882 in Magoffin County, Kentucky. She was born in January of 1829 in Kentucky. Elizabeth Jane Derossett married (1) JOHN W. KIMBERLIN February 11, 1847 in Prestonsburg, Floyd County, Kentucky. He was born about 1812 in Virginia, and died November 1, 1882 in Magoffin County, Kentucky.

Conley Jr.," son of Edmond Conley and Jane Phelpry, was born January 10, 1823 in Kentucky, died April 10, 1902, and was buried in the Blanton/Conley Cemetery on Litteral Fork in Magoffin County, Kentucky. He married Elizabeth McCarty, daughter of Thomas and Margaret McCarty, on December 14, 1846 in Johnson County. She died June 7, 1880 and was also buried in the Blanton/Conley Cemetery. Edmond and Elizabeth had 13 children and their names were taken from an old deed as coveyed to John H. Conley in December 29, 1913.

According to Paintsville genealogist and family historian, Joseph Eugene Conley, Edmund Conley III was born January 10, 1823 in Morgan County, Kentucky, and died April 10, 1902 in Litteral Fork, Magoffin County. He married Elizabeth McCarty December 14, 1846 in Johnson County. She was born about 1826.

John and Elizabeth DeRossett Kimberlin's daughter, Mary Jane "Mollie" Kimberlin, married Andrew E. Love. Their daughter, Sarah, married Eugene Becklard "Dock" Conley.

From June Kimberlin:

     "I saw your website today. Although I am not a Conley descendant, I have distant cousins who married into the Conleys and have researched family history since about 1990. My ancestor Elizabeth Jane DeRossett married John W. Kimberlin on 11 Feb. 1847 Prestonsburg. They lived on State Road Fork in what is now Magoffin county. John W. Kimberlin volunteered for the Union Army and served as an ambulance wagon driver. His training as a blacksmith was probably helpful in this capacity. John W. Kimberlin died on 1 Nov. 1881 in Magoffin county. His widow Elizabeth Jane then married widower Edmond Conley in May 1882. The Magoffin County Historical Society marriage book (1860-1910) has this record. Edmond's first wife was Elizabeth McCarty. You can see how confusing this would be for future family researchers. You are showing the second wife of Edmond as possibly Nancy Williams, widow of Wyatt. Now as it so happens, they are another set of great grandparents of mine. Let me explain how Steve Williams belongs in this family. John W. Kimberlin and Elizabeth Jane DeRossett had a daughter Minerva Anne Kimberlin who married Chandler Williams on 4 Sept. 1869. You will see Chandler and Minerva Ann on the 1870 Magoffin Census. Chandler was the son of Wyatt and Nancy Little Williams. He and Manerva had some children. He died in 1881 after a livestock drive to Mt. Sterling. Before Chandler died, he knew he was dying and asked Manerva to marry his younger brother Steve Williams so that his family and property could be kept together. They agreed. Steve and Manerva are living in the Edmond and Elizabeth Jane DeRossett Kimberlin Conley home in 1900 Magoffin County census. Along with therm are Tom Williams, a son of Chandler and Minerva, and then Luther, Wonnie, and Nona, which are all Steve and Manerva's children. Minerva is a step daughter of Edmond Conley, Steve is a step son-in-law and the children are step grandchildren. And another reason that I take a interest in this story is that my great grandfather Granville D. Kimberlin, son of John W. and Elizabeth DeRossett Kimberlin, married Polly Anne Williams, a daughter of Wyatt and Nancy Little Williams."

According to Kentucky birth records, Sarah Kimberlin was born August 8, 1856 in Licking, Floyd County, to John Kimberlin and Elizabeth Jane Derossett.

According to Magoffin County marriage record transcripts, Edmond Conley married Elizabeth Kimberlan on May 10, 1882 in the home of Nehemiah Crace. The witnesses were John W. Penix and Elizabeth Crace and the minister was Nehemiah Crace.

On page 43 of the 1850 census for Johnson County, Kentucky (dated August 30, 1850), Edmund Conley is listed as the head of the household for house #284, he's a farmer, born in Kentucky, and he's 25 years old. Also listed are Elizabeth (born in Virginia, age 22), James (born in Kentucky, age 2), and Sarah (born in Kentucky, age 1). They are living next to Elizabeth's parents.

On page 158 of the 1850 census for Morgan County, Kentucky (dated October 1, 1850), John W. Kimberling is listed as the head of the household for house #1047, he's a blacksmith, born in Virginia, and he's 31 years old. Also listed are Elizabeth (born in Kentucky, age 21), and Manerva (born in Kentucky, age 1).

WILLIAM SMITH CONLEY, son of EDMUND CONLEY JR. and JANE PELPHREY, was born February 2, 1828 in Morgan County, Kentucky, and died October 24, 1895. He married (1) NEUCARIUS FITZPATRICK on March 15, 1844 in Johnson County, Kentucky. She was born August 16, 1830 in Kentucky, and is buried in Dassel Community Cemetery in Dassel, Meeker County, Minnesota. He married (2) REBECCA CAUDILL, daughter of BENJAMIN CAUDILL and ABIGAIL PENNINGTON, January 1, 1859 in Morgan County, Kentucky. She was born about 1830 in Kentucky. Neucarius Fitzpatrick Conley married (2) JOSEPH FOSTER. He was born November 29, 1837 in Kentucky, died May 1, 1907, and is buried in Dassel Community Cemetery in Dassel, Meeker County, Minnesota.

Notes: Information on this family can be found on page 36 of "The Conley Clan of Eastern Kentucky," published and sold by The Magoffin County Historical Society. In that book it says that Williams Smith Conley, son of Edmond and Jane Phelphry Conley, was born February 2, 1828, and died October 24, 1895. He married Narcissus Fitzpatrick on March 24, 1895, and they were divorced in 1859. William then married Rebecca Caudill, daughter of Benjamin and Abigail Pennington Caudill. It also says that William Conley was in Company D of the 45th Kentucky M. D. Infantry.

Neucarius Fitzpatrick was reportedly born August 18, 1930, and died July 16, 1919 in Spencer, Ward County, North Dakota. She and her second family moved to Minnesota prior to 1880, with daughters Nancy and Martha moving there about the same time.

According to Kentucky marriage record transcripts, William S. Conley married Neucarius Fitzpatrick on March 15, 1844 in Johnson County.

According to Kentucky marriage record transcripts, William S. Conly married Rebecca Caudill on January 1, 1859 in Morgan County.

William S. Conley filed for a pension from his service in the Civil War on January 22, 1872, and that application says that he was an invalid. On January 10, 1896, his widow, Rebecca, filed for her right to the pension.

Information found on findagrave.com and a photo of their headstone shows that Neucarius Foster was born August 16, 1830, and was buried in Dassel Community Cemetery in Dassel, Meeker County, Minnesota, that Joseph E. Foster lived from November 29, 1837 to May 1, 1907, was buried in the same cemetery, that Harland Foster lived from November 10, 1872 to April 20, 1890, was buried in the same cemetery, and that Margaret A. Foster lived from October 20, 1870 to May 22, 1902, and was buried in the same cemetery.

On pages 15 & 16 of the 1860 census for Magoffin County, Kentucky (dated June 18 & 19, 1860), Wm. S. Conley is listed as the head of the household for house #103, he's a farmer, born in Kentucky, and he's 33 years old. Also listed are Rebecca (born in Kentucky, age 33), John D. He was born in May of 1866 in Kentucky, and died March 7, 1937 in Oil Springs, Johnson County, Kentucky. Frank Gibson married (2) MINNIE LITTERAL, daughter of MINARD LITTERAL and MARY COLE, July 18, 1916 in Johnson County, Kentucky. She was born about 1894 in Kentucky, and died before 1937. Minnie Litteral married (1) (unknown first name) HACKWORTH.

Notes: It's not clear how Frank Gibson was the son of David Salyer and Assie Collins and ended up with the last name of Gibson. That information comes from his death certificate which was filled out by his son. It's possible that he was adopted.

According to his death certificate, John Gipson died April 13, 1917 in Johnson County, Kentucky, from complications of a premature birth. According to her death certificate, Nancy Jane Caudill Conley died October 1, 1913 in State Road Fork, Magoffin County, Kentucky, from chronic diarrhea. Also on that certificate, her birthplace is listed as Floyd County, Kentucky, her birth date is listed as May 13, 1836, her marital status as widowed, her parents as Ben Caudill (b. North Carolina) and Abby Penington (b. North Carolina), and the burial place as Alonzo Conley Graveyard in Salyersville.

HENRY JACKSON CONLEY, son of EDMUND CONLEY JR. and JANE PELPHREY, was born about 1836 in Floyd County, Kentucky, and died in 1900. He married (1) ELIZABETH CRACE, daughter of CAMPBELL C. CRACE and MAHALA CRAFT, December 4, 1859 in Morgan County, Kentucky. She was born about 1839 in Perry County, Kentucky, and died about 1882. He married (2) TEMPY GULLETT, daughter of IRA GULLETT and LYDIA PELPHREY, September 16, 1883 in Johnson County, Kentucky. She was born in February of 1848 in Kentucky, and died about 1907.

Tempy Gullett was the sister of Daniel P. Gullett and James B. Gullett.

According to Kentucky marriage record transcripts, Ira Gullett married Lydia Pelphrey on January 8, 1846 in Johnson County.

According to Kentucky birth records, Joseph W. Gullett was born July 13, 1855 in Johnson County to Ira Gullett and Lydia Pelphrey, James B. Gullett was born March 8, 1857 in Johnson County to Ira Gullett and Lydia Pelphrey, and Lydia Gullett was born December 15, 1859 in Johnson County to Ira Gullett and Lydia Pelphry.

It's hard to read the date on the marriage record for Henry J. Conley and Elizabeth Crace, but it is the 4th of some month in 1859 in Morgan County, and the transcript says that it's December 4th. Henry is 22 years of age and Elizabeth is 20. Henry's birthplace is Floyd County and Elizabeth's is Perry County.

According to Kentucky marriage record transcripts, Henry J. Conley (2nd marriage, age 47) married Tempy Gullett (age 34) on September 16, 1883 in Johnson County.

From the book "The Southwestern Reporter," printed in 1913, in which the case Saylor vs. Saylor (among many other cases) is discussed:

     "Martin Saylor owned a tract of land on Oil Springs fork of Little Paint Creek, in Breathitt county, Ky., which he had purchased from Thomas Crace and Ben Caudill in the year 1882. He had several children and grandchildren. On August 11, 1908, Martin Saylor and his wife, Margarett Saylor, conveyed the above tract of land to his son, Garfield Saylor, in consideration of certain payments to be made by Garfield to support and maintain the grantors so long as they lived. A few days previous to the execution of this deed, and on July 18, 1908, Martin Saylor made a will, by which he made certain bequests to certain of his children, and devised the same land to his son Garfield. The will contains the following provision: "I, Martin Saylor, do will Henry Saylor $110 which he owned me for borroed money." Martin Saylor died in the year 1909. His will was offered for probate on November 22, 1909. Henry Saylor and others objected to its probate. The will was probated, and on appeal by Henry Saylor and others to the Breathitt circuit court the jury found in favor of the will, and judgment was entered accordingly.
     "After the will had been sustained, plaintiff, Henry Saylor, brought this action against Garfield Saylor and the other heirs of Martin Saylor to recover half interest in the land in controversy, basing his cause of action on the following title bond:
     "This bond of conveyance made and entered this August 13, 1904. Martin Saylor of Magoffin county, party of the first part, and Henry Saylor, party of the second part, of same county and state. The said Martin Saylor, for and in consideration of the sum of seven hundred and fifty ($750.00) dollars, for his part of the land that he helped to pay for purchased from Ben Caudill, lying and being on Little Paint, and bounded as follows: Beginning on a beech tree at the lower end of a farm, running with the conditional line between Ben Saylor and Martin Saylor to Jim Rice line, up the ridge to John Pace line, with said line to Taylor Bailey's, with the ridge to Ben Saylors line, with said line in the beginning. Said Martin Saylor this day binds himself to make a lawful title; if fails to do so binds himself to pay Henry Saylor seven hundred and fifty ($750.00) dollars.

     "[1] The defendant, Garfield Saylor, being the only real party in interest, is only defendant who made defense. He interposed a plea of res adjudicata, based on the judgment of the Breathitt circuit court sustaining Martin Saylor's will, and also a plea of non est factum. On final hearing the chancellor gave judgment in favor of the defendant, and plaintiff appeals.
     "Manifestly the plea of res adjudicata is not available as a defense. In the will contest the only question determined, or that could have been determined, was will or no will. Henry Saylor's right to one-half of the land in controversy was not litigated, and could not have been litigated, in the will contest. That being true, the judgment sustaining the will is not conclusive of Henry Saylor's right to recover the land under and by virtue of the title bond. It therefore becomes necessary to consider the plea of non est factum.
     "[2, 3] As plaintiff, Henry Saylor, testified for himself, and his evidence consists of transactions had and statements made by his father, who was dead at the time plaintiff testified, it follows that Henry Saylor's evidence is incompetent and cannot be considered. Section 606, subsec. 2, Civil Code. The fact that defendant's attorneys cross-examined plaintiff on these matters did not render plaintiff's testimony competent. A party has the right, not only to object to testimony on the ground of its inadmissibility or the incompetency of the witness, but to cross-examine a witness with reference to such incompetent matter, and does not waive his right to object to incompetent testimony by reason of such cross-examination. If the rule were otherwise, a party would often be deprived of the right of cross-examination in cases where he and the court differed as to the competency of the evidence.
     "The only portion of Henry Saylor's testimony that is competent is his statement that he paid on the land in controversy the sum of $100 to Ben Caudill, and to Anderson Blanton a horse valued at $125.
     "[4] James Blanton, whose name appears on the bond as an attesting witness, testified that there was a bond given. He could not remember whether he had given leave for his name to be signed to the bond or not. Frank Blanton was by. He heard the old man say he aimed for Henry to have his part of the land. The bond was written about six or seven years ago at Martin Saylor's house. Did not know and could not recollect who wrote the bond. It seems like it was read in his hearing. When Martin Saylor made the statement in regard to Henry, Martin was at home sick; did not know anything about what was in the bond. Frank Blanton testified that he could not read or write. He was at Martin Saylor's, and they wrote something and said it was a bond. James Blanton was present and some one else; he did not know who. It had been six or seven years ago. Margarett Saylor wrote the bond.
     "The defendant, Garfield Saylor, testified that he never heard of the bond until after the judgment in the will contest. His father lived with him all the time. Witness was at home nearly all the time. His sister, Margarett Saylor, did not spell her name 'Margarett Saylor,' but 'Margaret Sailor.' On cross-examination, it developed that this witness was away from home at different times.
     "It will be observed that neither Frank nor James Blanton identified the bond in controversy as the bond which they claim to have seen executed. Indeed, Neither one of them testifies that Martin Saylor was even present, or that he authorized his name to be signed to it. James does not remember who wrote the bond. He does not remember whether he authorized his name to be signed as attesting witness or not. Neither one of those witnesses could tell what was in the bond. Indeed, their evidence is very vague and unsatisfactory. Aside from the unsatisfactory character of the evidence by which it is attempted to prove the execution of the bond, it appears from the will of Martin Saylor that the plaintiff, Henry Saylor, was indebted to him in the sum of $110, which sum he devised to Henry Saylor as his part of the estate. It does not seem probable that Martin Saylor would have executed a title bond acknowledging an endebtedness of $750, when, as a matter of fact, Henry Saylor was at that time indebted to him. Nor does it seem probable that Martin Saylor would have conveyed or devised the land to his son Garfield and directed the latter to pay Henry the sum of $110 if, as a mattor of fact, he had previously executed the title bond. Another circumstance that must be taken into consideration is this: Plaintiff never undertook to enforce this bond during the lifetime of his father and Margarett Saylor. He waited until both were dead. Even upon the death of his father, he did not first institute suit on the title bond, but sought to break his father's will, when, if the will had been broken, his part of the estate would not have been as large as that portion which he could have recovered if the title bond had been valid. He first contests the will, and, when defeated in that action, he sues on the title bond, when a person with an eye to his own interest would have naturally sued first on the title bond itself. In view of these most potent facts, and of the unsatisfactory character of the evidence by which it is sought to establish the execution of the bond in question, we see no reason to disturb the finding of the chancellor in favor of the defendant.
     "Judgment affirmed."

Martin Saylor was the brother of Malissa Saylor and Benjamin Daniel Saylor.

According to Kentucky death records, Pleasant Blanton (farmer, married, b. Harlan County, age 21), son of James H. and Dicy Blanton, died November 16, 1855 in Johnson County from typhoid fever.

According to Kentucky marriage records, Clarenda Blanton married Martin S. Salyer [sic] on May 31, 1860 in Johnson County.

She married MATTHEW C. PACE, son of JOHN P. PACE and SARAH "SALLY" ELY, April 5, 1855 in Johnson County, Kentucky. He was born May 12, 1836 in Harlan County, Kentucky, died December 8, 1908, and is buried in Mathie Pace Cemetery in Conley, Magoffin County, Kentucky.

Notes: Information on this family can be found on page 180 of "The Conley Clan of Eastern Kentucky," published and sold by The Magoffin County Historical Society. In that book it says that Elizabeth and Mathew [sic] were married on April 5, 1855.

She married SIMEON S. SLUSHER, son of WILLIAM SLUSHER and MARY "POLLY" JACKSON, May 9, 1857 in Morgan County, Kentucky. He was born in July of 1834 in Harlan County, Kentucky, died November 6, 1903 in Konowa, Seminole County, Oklahoma, and is buried in Violet Springs Cemetery in Asher, Seminole County, Oklahoma.

Notes: This branch of the Conley family is based partly on information that was found on ancestry.com and partly on information received by descendant - through daughter Amanda - Joretta Pickard. As much proof as could be found is posted here and on the pages of Keziah's descendants.

They lived in Magoffin Co Ky (Dist. 1) until the Civil War. Simeon joined the Union Army. After the war, he and his wife removed to the mid west."

According to Kentucky marriage record transcripts, Kissey Salyer married Simion Slusher on May 9, 1857 in Morgan County.

According to Civil War draft registration records, Simon Slusher registered in June of 1863 in Indiana. He was a laborer, born in Kentucky, married, and he was 27 years old.

According to Civil War record transcripts, Simeon Slusher was living in St. Omer, Indiana, when he enlisted in as a private in Company G, 123rd Infantry Regiment Indiana on January 21, 1864. He mustered out on August 25, 1865 in Raleigh, North Carolina.

According to Kentucky marriage record transcripts, Simion Slusher married Kissey Salyer on May 9, 1857 in Morgan County.

According to Civil War pensions records, Simon Slusher filed for a pension on April 29, 1876, and Kizzie Slusher filed as a widow on January 5, 1904 in Oklahoma Territory.

According to Civil War headstone application records, Simeon Slusher died November 6, 1903, and was buried in Violet Cemetery in Oklahoma.

Simeon Slusher was appointed Postmaster in Madge, McDonald County, McDonald County, Missouri, on May 31, 1898, but a note on that record says "Failed to qualify."

Simeon Slusher was sworn in as U.S. Deputy Marshall in Fort Smith, Sebastian County, Arkansas, on June 21, 1889, and was shot and wounded 15 days later.

Information found on findagrave.com and a photo of their headstones shows that Kizzie Slusher, wife of Simeon S. Slusher, lived from May 31, 1840 to January 4, 1917, and was buried in Violet Springs Cemetery in Asher, Pottawatomie County, Oklahoma, and that S. Slusher was buried in the same cemetery. Part of Kizzie's headston is blocked by flowers, but the correct information was provided by descendant Joretta Pickard.

On page 63 of the 1860 census for Magoffin County, Kentucky (dated July 12, 1860), Simion Slusher is listed as the head of the household for house #430, he's a farmer, born in Kentucky, and he's 24 years old. Also listed are Kizza (born in Kentucky, age 21), and Mary (born in Kentucky, age 2).

He married ELIZABETH M. "LIZZIE" SMITH, daughter of GEORGE H. SMITH and KATHERINE "KATE" ISAACSON, about 1903 in Wyoming, Chisago County, Minnesota. She was born January 28, 1885 in Canada, died April 2, 1963 in Hennepin County, Minnesota, and is buried in Oak Leaf Cemetery in Bethel, Anoka County, Minnesota.

Crace lived from 1885 to 1963, and was buried in the same place in the same cemetery. Lizzie's parents are buried in the same cemetery.
